Client Contract

In the following terms & conditions “the Photographer” shall mean Ciara Menzies trading as ‘Ciara Menzies Photography’. “The Client(s)” shall be those persons defined as those making a booking for services using the ‘Client Agreement + Booking Form’ available on the Photographer’s website. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Booking Fee / Deposit Payments

The full monetary amount due to the Photographer for any services rendered will be agreed in writing between The Photographer and the Client prior to the completion of the online booking form. Details such as the location and date of the photo shoot will also be agreed with the completion of the online Client Agreement + Booking form. A non-refundable booking fee of 25% of the full amount agreed between the Photographer and the Client should be paid at the time of booking; by paying this deposit you also accept the full terms and conditions as stated in this document. This is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due.

Cancellation

In the highly unlikely event of cancellation due to injury, extreme illness, or an unavoidable total photographic failure that prevents Ciara Menzies Photography from photographing the event, Ciara Menzies Photography’s liability shall be limited to a full refund of any booking fee or fees paid. Reshoots may be arranged if practicable but Ciara Menzies Photography will not be responsible for any further costs.  Ciara Menzies Photography will endeavour to appoint another photographer to attend a booking however it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.

The Client may cancel this contract at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Cancellation less than two weeks before the event will result in the payment in full becoming due. All cancellations must be in writing.

House Rules

Clients agree and understand that Ciara Menzies Photography is limited by the guidelines of the location site/venue management/government rules and clients agree to accept the results that may occur from said guidelines. Negotiation with the officials/management for moderation of guidelines is solely the Clients responsibility. If Client appears under the influence of alcohol or drugs during the shoot, Ciara Menzies Photography has the right to cancel the shoot immediately due to public liability and health and safety concerns.

Model Release

Ciara Menzies Photography reserves the right to publish photographs of the Clients or in which the Clients may be included, for editorial, trade, advertising or any other commercial purpose. The clients hereby release Ciara Menzies Photography and all associates, representatives and assigns from any and all claims, actions, demands, litigation, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to Ciara Menzies Photography’s use of said images.

Images + Copy Rights

Photographs/images produced by Ciara Menzies Photography are protected by Copyright and remain the property of Ciara Menzies Photography. Upon final payment by clients, clients are allowed to display resulting images for personal use only. Said images may not be digitally altered in any manner without prior written permission of Ciara Menzies Photography. Clients will receive a high resolution USB or internet transfer with printing rights. When publishing the photos on social media, Ciara Menzies Photography must be credited as the photographer. The Client must not benefit commercially from the reproduction of these photographs in any form. Ciara Menzies Photography will choose the best images from your session. The client does not take part in the process of choosing which images will be selected for the final gallery. Every images that is chosen will be fully edited to Ciara Menzies Photography’s high standard.

Limit of Liability

Ciara Menzies Photography takes the upmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Ciara Menzies Photography's control. The client agrees that Ciara Menzies Photography or the Photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event. 

Completion Schedule

Images can be expected to be edited within 2-12 weeks after the photo shoot date dependant on the volume of photographs taken. USB delivery can be expected within this time frame, but may take longer.
